  3. Counter Notification
    If you are a customer or MLS-Dominican.com website user who has received notice from us that your Content has been removed following our receipt of a notice of claimed copyright infringement, and you are the owner of the allegedly infringing Content or are otherwise authorized to use such Content (including ‘fair use’) and it is not possible to come to an agreement with the reporting copyright owner, you may provide written counter notification to our designated DMCA agent. Your counterclaim notification must include substantially the following information:

    1. Your physical or electronic signature;
    2. Identification of the allegedly infringing material including the location at which the material appeared before it was removed or access to it was disabled;

  4. Repeat Infringement
    MLS-Dominican.com does not condone or tolerate copyright infringement or any violation of the intellectual property rights of Infotech or of others. MLS-Dominican.com reserves the right to terminate the access and/or use privileges of any person who has been determined to be a ‘repeat infringer’ of the copyrights of MLS-Dominican.com or others. MLS-Dominican.com reserves the right to define the criteria by which Infotech will determine that a person is a ‘repeat infringer.’ In the event that repeat infringer’ is defined by statute, law, or regulation as applicable to 17 USC § 512, MLS-Dominican.com will adopt that definition as a minimum standard. Without limiting MLS-Dominican.com’s right to define ‘repeat infringer,’ as a general rule, MLS-Dominican.com will define a ‘repeat infringer’ as any person or entity about whom MLS-Dominican.com has received two or more DMCA Notices of Alleged Infringement. MLS-Dominican.com will take into account all relevant facts and circumstances of any and all incidents when determining whether or not termination of access and/or use privileges of a ‘repeat infringer’ is appropriate.
